Design Terms

COPYRIGHT: Upon final payment of this contract, the client is assigned rights to use as graphics and text contained in the finished assembled research. Rights to photos, graphics, source code, work-up files, and computer programs remain the property of the client and their respective owners and creators. The client agrees that all laws of copyright are subject responsibility by the client. 

1) Reservation of Rights: Shaping Art and any partnering websites of Shaping Art have the right to showcase development work in their portfolios.

2) Revisions: Client shall have 1 revision round in which client can request minor changes or adjustments based on the above Project Details and not beyond that scope. Additional fees will be charged at a rate of $AGREED UPON/hr for requests made outside of the scope of the project or for additional revisions that goes beyond the estimated hours. 

3) Payment: The estimate is subject to a 20% decrease or increase based on unforeseen changes. Payment for finished work is due upon acceptance, net fifteen (15)  or thirty (30) days depending on the preference of the Client. The Client's right to use the work is conditioned upon receipt of payment within thirty days of acceptance, and upon Client's compliance with the terms of this agreement. A two percent (2%) monthly service charge will be billed against late payment.  

Yoga Terms

By renting or buying a yoga hammock, joining a class or private session I agree to the following terms and conditions:  In consideration of participating in Hammock Aerial Yoga at any location, I represent that I understand the nature of Hammock Aerial Yoga and that I am qualified, in good health, and in proper physical condition to participate in such Activities. I will not have more than one person in the hammock as they are designed for one person.  I will not wear jewelry which can rip the hammock or intentionally rip the fabric. I fully understand that such activity involve risks of SERIOUS BODILY INJURY, INCLUDING BUT NOT LIMITED TO PERMANENT DISABILITY, PARALYSIS AND DEATH. I fully accept and assume all such risks and all responsibility for losses, costs, and damages I incur as a result of my participation in the Hammock Aerial Yoga. I hereby release, discharge, and covenant not to sue Ashley Johnson, Shaping Art or any other associated parties such as yoga hammock manufacturer or landlords, etc, “Releasees” its respective administrators, directors, agents, officers, volunteers, and employees, other participants, any sponsors, advertisers, and, if applicable, owners and lessors of premises on which the Activity takes place from all liability, claims, demands, losses, or damages on my account caused or alleged to be caused in whole or in part by the NEGLIGENCEof the "releasees" or otherwise, including but not limited to NEGLIGENT RESCUE OPERATIONS; the release exculpates Ashley Johnson, Shaping Art or any other associated parties such as yoga hammock manufacturer or landlords, etc, from liability for ACTS OF NEGLIGENCE RELATED AND UNRELATED TO INHERENT RISKS ; this release does not represent or insinuate standards of safety or maintenance; and I further agree that if, despite this release, waiver of liability, and assumption of risk I, or anyone on my behalf, makes a claim against any of the Releasees, I will indemnify, save, and hold harmless each of the releasees from any loss, liability, damage, or cost which any may incur as the result of such claim.

I have read this RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT, AND PARENTAL CONSENT AGREEMENT, understand that I have given up substantial rights by signing it and have signed it freely and without any inducement or assurance of any nature and intend it be a complete and unconditional release of all liability to the greatest extent allowed by law and agree that if any portion of this agreement is held to be invalid the balance, notwithstanding, shall continue in full force and effect.e
